Terms of Service
These Terms of Service govern your access to and use of ChibiArts. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
1. Acceptance of Terms
By accessing or using ChibiArts you agree to be bound by these Terms and by our Privacy Policy. We may update these Terms from time to time; continued use after changes are posted means you accept the revised Terms.
2. Eligibility
You must be at least 18 years old to create an account and use ChibiArts. By creating an account you represent that you meet this requirement.
3. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. You may close your account at any time from the account settings.
4. Credits and Subscriptions
ChibiArts uses a credit system. One credit produces one image render across any of the ten generators. The emoji tool is the exception in your favour: one credit returns a sixteen-tile sticker sheet. The built-in animated meme library costs no credits — only generating a fresh base image does. Video rendering is charged by frame. The free plan includes one credit per month at 800×800 output with no card required. Premium ($5/month) and Ultimate ($10/month) include 60 and 140 credits respectively and output at 1024×1024. Credits reset every month and do not roll over. Paid plans can be cancelled at any time; access continues until the end of the current billing period.
5. Payments and Refunds
Payments are processed by a third-party payment provider, so we never store your full card details. Refund requests may be made within 7 days of purchase provided the credits have not been substantially used.
6. Acceptable Use
You agree not to use ChibiArts to generate, upload, or share content that is unlawful, infringing, defamatory, hateful, sexually explicit involving minors, or that depicts real identifiable individuals without consent. You may not reverse engineer the service, scrape it at scale, or use it to build a competing product. We may suspend or terminate accounts that violate these rules.
7. Your Uploads
Photos and images you upload are used solely to produce the generation you request. We do not use your uploads to train models or for any purpose beyond fulfilling your request. You confirm you have the right to upload and process the material you submit.
8. Ownership of Generated Artwork
You retain ownership of the artwork you generate. All plans, including the free plan, grant you full commercial rights to use generated artwork in merchandise, client work, or any other project without a separate licence. Our brand assets, templates, preset names, and marketing materials remain our property.
9. Third-Party AI Providers
Image generation runs on third-party AI models (including Nano Banana Pro) and video generation on ByteDance Doubao Seedance 2.0 Fast, accessed through our server-side proxy so provider API keys never reach your browser. By using the service you acknowledge that requests are processed by these providers under their own terms.
10. Service Availability
We strive to keep ChibiArts available but provide it on an ‘as is’ basis. Scheduled maintenance, provider outages, or high demand may cause interruptions. We are not liable for any unavailability.
11. Disclaimers
The service is provided without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that generated content will meet your expectations or be error-free.
12. Limitation of Liability
To the maximum extent permitted by law, ChibiArts and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid in the preceding month, if any.
13. Indemnification
You agree to indemnify ChibiArts against any claims, losses, or expenses arising from your use of the service or your violation of these Terms.
14. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the service at any time. Sections relating to ownership, liability, and indemnification survive termination.
15. Changes and Governing Law
We may revise these Terms; the ‘last updated’ date reflects the latest version. These Terms are governed by the laws of the jurisdiction in which the operating entity is established, without regard to conflict-of-law principles.
